That doesn't look to me like a bird of prey. I don't know what kind of bird would take that pose; maybe the author can enlighten us.

Looks like a tern hovering before diving for a fish. From the Piscean point of view, a tern for the worst. Many terns have a deeply forked tail like this.

I thought that were the legs, not the tail, and it was landing.
